Terms of Use

1. Introduction

These Terms of Use (“Terms”) govern access to and use of the CondoVue software platform, website, and related services (collectively, the “Service”) operated by CondoVue.ca - 9350-5501 Québec Inc. (“CondoVue”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.


2. Description of the Service

CondoVue is a cloud-based software platform designed to assist condominium syndicates, property managers, board members, and residents in managing condominium operations, including but not limited to:

  • Financial management
  • Accounting and reporting
  • Budget management
  • Communication with residents
  • Document management
  • Maintenance tracking
  • Governance and board administration

CondoVue may update, modify, or enhance the Service at any time.


3. Eligibility and Accounts

To use the Service, you must:

  • Be at least 18 years old
  • Have the legal authority to represent an organization if creating an account on its behalf
  • Provide accurate and complete registration information

Users are responsible for maintaining the confidentiality of their login credentials.

You agree to notify CondoVue immediately if you suspect unauthorized use of your account.


4. Organizational Accounts

CondoVue is typically used by condominium syndicates, property management companies, or similar organizations (“Organizations”).

The Organization is responsible for:

  • Managing user access
  • Assigning roles and permissions
  • Ensuring compliance with applicable laws
  • Maintaining the accuracy of information entered into the system

Users associated with an Organization act under the authority of that Organization.


5. User Responsibilities

You agree not to:

  • Use the Service for unlawful purposes
  • Attempt to gain unauthorized access to the system
  • Interfere with the operation of the Service
  • Upload malicious code or harmful content
  • Use the Service to harass, threaten, or harm others

You are responsible for all content and data you upload or manage through the Service.


6. Data Ownership

All data entered into the Service by an Organization remains the property of that Organization.

CondoVue acts solely as a service provider hosting and processing such data.

CondoVue does not claim ownership over organizational or user data.


7. Privacy and Personal Information

CondoVue processes personal information in accordance with its Privacy Policy and applicable laws, including Quebec's Law 25 respecting the protection of personal information.

Organizations using the Service remain responsible for ensuring they collect and process personal information lawfully.


8. Security

CondoVue implements reasonable technical and organizational security measures designed to protect the integrity and confidentiality of data.

However, no system can guarantee absolute security.

Users remain responsible for maintaining strong passwords and controlling access to their accounts.


9. Availability of Service

CondoVue will make reasonable efforts to maintain the availability of the Service but does not guarantee uninterrupted or error-free operation.

The Service may be temporarily unavailable due to:

  • Maintenance
  • System upgrades
  • Technical failures
  • External service disruptions

10. Third-Party Services

The Service may integrate with third-party services including but not limited to:

  • Payment processors
  • Email providers
  • Cloud infrastructure providers
  • Accounting integrations

CondoVue is not responsible for the availability or reliability of third-party services.


11. Intellectual Property

All software, interfaces, design elements, trademarks, and intellectual property related to the Service remain the exclusive property of 9350-5501 Québec Inc.

Users receive a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You may not:

  • Reverse engineer the platform
  • Copy or reproduce the software
  • Resell the Service without authorization

12. Fees and Subscriptions

Some features of the Service may require payment of subscription fees.

Organizations agree to pay all applicable fees as specified in their subscription agreement.

Failure to pay fees may result in suspension or termination of access.


13. Limitation of Liability

To the maximum extent permitted by law, CondoVue shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits
  • Loss of data
  • Business interruption

The Service is provided “as is” and “as available”.


14. Termination

CondoVue may suspend or terminate access to the Service if:

  • These Terms are violated
  • Payment obligations are not met
  • The Service is used in a manner that could harm the platform or other users

Organizations may terminate their use of the Service at any time.


15. Modifications to Terms

CondoVue may update these Terms from time to time.

Users will be notified of material changes.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.


16. Governing Law

These Terms are governed by the laws of the Province of Quebec and the applicable laws of Canada.

Any dispute shall be subject to the jurisdiction of the courts located in the Province of Quebec.
